Republicans resist ban on guns in Capitol

October 13, 2020

There is a state law that prohibits carrying a firearm on the premises of any of the following:

  • a bank

  • a church

  • a court

  • a theater

  • a sports arena

  • a day care center

  • a hospital

  • a bar

Senate Bill 1159, introduced September 30, would add the Michigan State Capitol Building to that list. A person who violates this law is guilty of a misdemeanor punishable by 90 days in jail or a $100 fine or both. It was co-sponsored by 13 Democratic senators. No Republicans.

I wish they'd added not only the Capitol building, but also the Capitol grounds. It is such a beautiful place for people to gather, it's a shame to allow gun-toting morons to ruin it for everyone.

The bill was introduced before we learned of the plot to kidnap Governor and to storm the Capitol with an force of 200 armed "patriots". The FBI has found that six of the plotters met during a rally at the state Capitol in June. (source)

The Detroit Free Press reports that

House Speaker Lee Chatfield, R-Levering, told Michigan Information & Research Service Monday that he's not interested in banning guns inside the Capitol because it is the "people's house" and everyone has the right to express their constitutional rights.

Expressing constitutional rights

There is, however, no constitutional right to carry a firearm, concealed or not. The Second Amendment says only that "A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed." It is referring to militias - not just any militias, but militias well-regulated by the state. More on that here.

Senate Majority Leader Mike Shirkey, R-Clarklake told reporters “There is no way in a country like ours that you can legislate and get rid of all risk.” You can, however, reduce risk. Otherwise, why use seat belts? Why wear face masks during an pandemic? Oops, sorry, Republicans don't believe in reducing that risk, either.

"Open carry" on its face is terrorism. Someone walking around in public with an automatic rifle is frightening, and meant to be. It is disgusting and should not be allowed.

If it walks like a duck and quacks like a duck. . .
